Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver: You agree that disputes will be resolved only on an individual basis. You waive the right to participate in any class, collective, consolidated, or representative action against us.

Exception – Small Claims: Either party may bring an eligible claim in small claims court instead of arbitration.

Termination

We may suspend, restrict, or terminate your access to the Site at any time, with or without notice, for any reason, including any violation of these Terms or misuse of the Site. We will have no liability to you for any such suspension or termination.

Assignment

We may assign or transfer our rights and obligations under these Terms, in whole or in part, at any time without restriction. You may not assign or transfer any rights or obligations under these Terms without our prior written consent, and any attempted assignment in violation of this provision shall be void.

Entire Agreement & Waiver

These Terms, together with our Privacy Policy and any other policies or notices referenced herein, constitute the entire agreement between you and Kearns Mortgage Team, LLC regarding your use of the Site and supersede any prior or contemporaneous understandings or agreements.

Our failure to enforce any provision of these Terms shall not constitute a waiver of our rights to enforce that provision at a later time, nor shall any single or partial exercise of a right preclude any other or further exercise of that or any other right.

Governing Law & Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to the arbitration agreement above, any disputes arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the jurisdiction and venue of such courts.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
